Clinical biobanks processing data of participants in the European Union fall under the scope of the General Data Protection Regulation, which among others includes requirements for consent. These requirements are further specified by the Article 29 Working Party —an EU advisory body currently known as the European Data Protection Board. Unfortunately, their guidance is cause for some confusion. While the GDPR allows participants to give broad consent for research when specific research purposes are still unknown, the WP29 guidelines suggest that (...) additional consent for specific uses should be obtained in addition to broad consent when this becomes applicable. This discrepancy elicits the question whether clinical biobanks can fail the requirement of consent if they obtain broad consent, but not a specific consent for each biomedical study. We analysed this discrepancy within the framework of contextual integrity, in order to describe the context-relative informational norms that govern information flows in clinical biobanks. However, our analysis demonstrates that there is no uniform set of norms that can be applied to all clinical biobanks. As such, neither the GDPR nor the WP29 guidance can act as a “one size fits all” approach to all clinical biobanks. Rather, differences between clinical biobanks—especially regarding the scientific aims and patient populations—make the case for context-relative norms that determine the appropriate type of consent. The use of platelet rich plasma as a novel treatment is discussed in the context of a qualitative research study comprising 38 interviews with sports medicine practitioners and other stakeholders working within the English Premier League during the 2013–16 seasons. Analysis of the data produced several overarching themes: conservatism versus experimentalism in medical attitudes; therapy perspectives divergence; conflicting versions of appropriate evidence; subcultures; community beliefs/practices; and negotiation of medical decision-making. The contested evidence base for the efficacy of PRP is presented (...) in the context of a broader professional shift towards evidence based medicine within sports medicine. Many of the participants while accepting this shift are still committed to casuistic practices where clinical judgment is flexible and does not recognize a context-free hierarchy of evidentiary standards to ethically justifiable practice. We also discuss a tendency in the data collected to consider the use of deceptive, placebo-like, practices among the clinician participants that challenge dominant understandings of informed consent in medical ethics. We conclude that the complex relation between evidence and ethics requires greater critical scrutiny for this emerging specialism within the medical community. (shrink)

During the first week of October 1983, the Italian Institute for the Study of Philosophy, together with the Philosophical Seminar of the University of Tübingen, organized a public colloquium on Hegel’s philosophy of the natural sciences. Those attending included a selected group of Italian scholars doing advanced research into early nineteenth century German philosophy, students and members of the general public from Tübingen, and a number of specialists from elsewhere in Germany and from the Netherlands.

Soon after the Hegel Society of Great Britain was inaugurated in September 1979, the Chairman received a congratulatory letter from the President of the Hegel Society of America, suggesting that every effort should be made to develop, “more concrete and personal forms of collaboration and communication.” The generosity of this response has now borne fruit in a joint meeting of the two Societies, marking the one hundred and fiftieth anniversary of Hegel’s death. It took place between the first and fourth (...) of September 1981, at Merton College Oxford, and was devoted to the discussion of “Hegel’s philosophy of action: individual, culture and society”. This work exposes the development of Hegel’s political theory from its origins in Hegel’s reading of Sir James Stewart and the composition of the early theological writings, through the Philosophy of Right. Its principle value lies in showing how careful use may be made of Hegel’s earlier writings in interpreting his mature political philosophy. Avineri describes Hegel’s early dissatisfaction with the understanding of the state as an instrument for the protection of private property, and his attempts to develop a concept (...) of ethical community. Developments of the latter notion are seen in the anti-nationalism of The German Constitution, as well as in the theories of property, class, and representation contained therein. Avineri shows the inappropriateness of ascribing to Hegel a political romanticism, regarding either Prussia or Classical Greece. And in his comments on the System der Sittlicheit [[sic]] and the Realphilosophie, he offers detailed and valuable commentary on Hegel’s early concept of labor. He demonstrates here Hegel’s sensitivity to the complex economic reality of modern society, and shows the early Hegel’s ability to describe labor, class divisions, commodity production, money, and alienation in ways remarkably akin to Marx. Here too Hegel’s notion of the state as that which overcomes the private character of production in civil society and constitutes society as an ethical community is seen. (shrink)

Insights gained from patient experiences related to tumour heterogeneity, access to targeted therapies and incidental findings of pathogenic germline variants in tumour DNA, provided practice-changing evidence for the implementation of a cost-minimisation pathology-supported genetic testing strategy.
